1. DATA CONTROLLER
DAUSS Abogados, S.L.P. (hereinafter, “DAUSS”) with registered office at Rambla Catalunya, 52 4º 08007 Barcelona, is the Data Controller of the personal data collected, obtained or generated when accessing, using and browsing our website and of the data provided, collected obtained or generated through the contact section in this website.
2. PURPOSE OF THE PROCESSING OF THE DATA AND CATEGORIES OF THE COLLECTED DATA
DAUSS will process the collected or provided data either manually or automatically and they will not be subject to automated decisions. The purpose of the data collection will be as follows:
- To provide the agreed legal services (these services may be provided by DAUSS directly or subcontracted);
- To send commercial information about our services or products to clients, adjusting this information to their profiles;
- To manage profiles of potential employees, collaborators or contractual partners;
- To Manage business relations with suppliers; and
- To comply with statutory requirements or meet the orders or requests of the competent authorities.
Considering the abovementioned purposes, DAUSS will process (i) personal data (full name, postal address, e-mail address, telephone number, etc.); (ii) financial data (bank accounts, tax returns, etc.); (iii) other necessary data for the development of the legal counsel; and (iv) academic and professional data (training, qualifications, professional experience and other relevant data for the selection of professionals).
3. DATA RETENTION PERIODS
DAUSS will only keep the user’s information for the time necessary to provide the services that have been agreed with DAUSS, as long as the consents granted are not revoked. Afterwards, and only if necessary, DAUSS will retain the provided data for the legally established periods.
In the event that the user has provided data in connection with a job offer or to submit an application, these will be retained for at least one year from the date of the last update.
Once the data retention periods have elapsed, they will be deleted in a secure manner.
4. IMPLEMENTED SECURITY MEASURES
DAUSS has implemented sufficient security measures to adequately protect users’ information. Security measures include technical security measures such as encryption of communications between users and DAUSS servers and the encryption of information on DAUSS servers itself.
DAUSS will not generally transfer your data to third parties outside the European Economic Area. However, in some cases it may occur, especially when users have personal and/or business relationships with others located in Switzerland or outside the EEA. In such cases, DAUSS will ensure that appropriate security measures are taken, and that the information is shared with the appropriate security measures and only to countries that ensure a data protection regulation similar to the one offered by the European Union.
5. DATA COMMUNICATION
Within the scope of the contractual relationship between the user and DAUSS and in compliance with the current legislation, DAUSS may be obliged to communicate personal data to public authorities (including courts), banks and other financial institutions, to other professionals as well as to law enforcement agencies, either for the proper provision of the services commissioned or when such communication is required by law.
The legal basis for the data processing lies on the user’s consent and the provision or execution of the contracted services. Data may also have to be processed by DAUSS as a result of legal requirements.
7. USER RIGHTS
The user may at any time and in accordance with the legislation in force, use his or her rights of access, rectification or suppression of personal data, to oppose to it, to request the limitation of its processing, its transferability and to revoke the previously expressed consent. In order to obtain a quick and efficient response, the user must clearly indicate the right or rights he/she wishes to use, as well as his/her full name and ID document. Likewise, the user is entitled to file a complaint with the Spanish Data Protection Agency (www.agpd.es – C/ Jorge Juan, 6 de Madrid), although DAUSS encourages the user to contact the office first.
